Terms and Conditions of Sale

Sales are not yet open. This page presents the terms planned for the future AFRO BRAIN® online store. They will be completed and updated before any order can be placed, in particular regarding prices, delivery costs and methods, and the consumer mediator. The applicable version will be the version available on the website on the date of the order.

1. Purpose

These Terms and Conditions of Sale govern sales of the colouring book “Fier de mes couleurs” and AFRO BRAIN® products offered on afrobrain.fr, published by Aurélie ADRUBAL. Placing an order implies full and unconditional acceptance of these Terms and Conditions of Sale.

2. Products

“Fier de mes couleurs” is a colouring book intended for children aged 6 to 10, containing 50 colouring pages and a parent guide. Product visuals shown on the website are as accurate as possible; minor printing variations may occur.

3. Prices

Prices are stated in euros, including all taxes (VAT included), excluding delivery charges. AFRO BRAIN® reserves the right to change its prices at any time; the applicable price is the price displayed when the order is placed.

4. Order and payment

Payment is made online by bank card through a secure payment solution. The order becomes final once payment has been confirmed; a confirmation email is then sent to you.

5. Delivery

Orders are shipped within metropolitan France, and to any other destinations specified at checkout, within the timeframes stated during order confirmation. In the event of delay or a damaged parcel, contact us at contact@afrobrain.fr.

6. Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, consumers have 14 days from receipt of the product to exercise their right of withdrawal without having to give a reason.

The request may be made using the standard withdrawal form that will be made available when sales open, or by any unambiguous statement expressing the wish to withdraw. The product must be returned within 14 days of notification of withdrawal. Direct return costs remain the responsibility of the consumer.

The product must be returned complete and properly protected. The consumer is liable only for any diminished value resulting from handling other than what is necessary to establish the nature and characteristics of the product. A book that has been coloured in, annotated, torn, stained, folded or otherwise damaged may therefore be subject to a reduction in the refund corresponding to the loss in value observed.

The refund will be made no later than 14 days after AFRO BRAIN® has been informed of the decision to withdraw. For goods, the refund may be withheld until the product has been recovered or until proof of dispatch has been provided, whichever occurs first.

7. Statutory warranties

All our products benefit from the statutory guarantee of conformity under Articles L.217-3 et seq. of the French Consumer Code and the warranty against hidden defects under Articles 1641 et seq. of the French Civil Code.

8. Consumer mediation

Before sales open, AFRO BRAIN® will appoint a competent consumer mediator. The mediator’s contact details and referral procedure will be stated on this page. Following a prior written complaint that remains unresolved, the consumer may refer the matter to the appointed mediator free of charge.

9. Applicable law

These Terms and Conditions of Sale are governed by French law, subject to any mandatory consumer-protection provisions that may apply. If a dispute cannot be resolved amicably or through mediation, jurisdiction will be determined in accordance with the applicable legal rules.

This English translation is provided for convenience. In the event of any discrepancy, the French version shall prevail.
